Georgia EPD takes comments through Nov. 12 on a Fayette County dam-breach buffer variance

The Georgia Environmental Protection Division posted public notice BV-056-26-02 on Oct. 14, 2026, for a request to encroach on the 25-foot state waters buffer for a permanent breach of an earthen dam in the Windsor Court subdivision in Fayette County. Written comments are due by Nov. 12, 2026.

The Georgia Environmental Protection Division (EPD) Watershed Protection Branch issued a public notice on Tuesday, Oct. 14, 2026, for buffer variance application BV-056-26-02 in Fayette County.

What is proposed. Pulte Home Corporation asked for a variance to work inside the 25-foot state waters buffer so an existing earthen dam in the Windsor Court subdivision can be breached and left open. The site is on Callaway Road in Fayette County, in the Flint River watershed (HUC 03130005), near GPS 33.4483, -84.4279. Planned work includes trenching through the dam, stabilization, revegetation and erosion-control measures. The notice says the buffer encroachment would cover 1,715 square feet along 66 linear feet of buffer next to an unnamed tributary of Nash Creek.

Legal basis. The request is a variance under the Georgia Erosion and Sedimentation Act and Erosion and Sedimentation Control rules (Chapter 391-3-7), considered under basis (a) of rule 391-3-7-.05(2).

Have your say. The comment period closes Thursday, Nov. 12, 2026. Comments should address environmental issues related to air, water and land protection. Put "Buffer Variance Comment" and the control number BV-056-26-02 in the subject line or at the top of written comments, and send them to EPDcomments@dnr.ga.gov or to EPD's Nonpoint Source Program, Erosion and Sedimentation Control, in Atlanta. Site plans are available for review in the Watershed Protection Branch File Room in Atlanta.
