Georgia EPD takes comments through Nov. 13 on Fairburn's Brooks Drive extension buffer variance

The Georgia Environmental Protection Division posted public notice BV-060-26-25 for the City of Fairburn's request to work within the 25-foot state waters buffer to extend Brooks Drive from Fisher Drive to Washington Street in Fulton County. Comments are accepted through Nov. 13, 2026.

The Georgia Environmental Protection Division (EPD) Watershed Protection Branch posted a public notice for buffer variance application BV-060-26-25 in Fairburn, Fulton County. The notice issue date is Oct. 15, 2026, and the 30-day comment period closes Friday, Nov. 13, 2026.

What is proposed. The City of Fairburn applied for a variance to encroach within the 25-foot state waters buffer to extend Brooks Drive from Fisher Drive to Washington Street. The work includes clearing and fill placement to build curb, gutter, sidewalk and roadway, along with erosion-control best management practices. The notice says the encroachments total 2,634 square feet along 207 linear feet within the buffer of an unnamed tributary of Line Creek, in the Middle Chattahoochee watershed (HUC 03130002), near GPS 33.5632, -84.5912.

Legal basis. The request falls under the Georgia Erosion and Sedimentation Act (O.C.G.A. § 12-7-1 et seq.) and the Erosion and Sedimentation Control rules (Chapter 391-3-7), and is being considered under bases (a) and (h) of rule 391-3-7-.05(2). The application must include an erosion and sediment control plan that meets or exceeds the standards in the Manual for Erosion and Sediment Control in Georgia.

Have your say. EPD says it has no authority to zone property or decide land use, so only comments on environmental issues related to air, water and land protection will be considered. Put "Buffer Variance Comment" and the control number BV-060-26-25 in the email subject line or at the top of written comments, and send them to EPDcomments@dnr.ga.gov or to EPD's Nonpoint Source Program, Erosion and Sedimentation Control, in Atlanta. Site plans are available for review in the Watershed Protection Branch File Room in Atlanta.

More information. The public notice is on EPD's Counties A–F buffer variance page (https://epd.georgia.gov/requests-state-waters-buffer-variance-counties-f) and as a PDF (https://epd.georgia.gov/document/document/bv-060-26-25-fulton-county-public-notice/download).
