McLennan County, Texas: TCEQ to consider City of Waco request to widen uses of its Brazos River water right at Lake Brazos on Oct. 21, 2026

The Texas Commission on Environmental Quality will take up hearing requests on the City of Waco’s application to amend its water right on the Brazos River, adding industrial, recreation and instream uses and letting the city divert its authorized water from anywhere along Lake Brazos, at its Oct. 21, 2026, meeting.

The Texas Commission on Environmental Quality (TCEQ) has posted its final agenda for its Wednesday, Oct. 21, 2026, commissioners’ meeting, and two items involve McLennan County.

Waco water right. The City of Waco has applied to amend Certificate of Adjudication No. 12-4318 to add industrial, recreation and instream purposes of use and to allow diversion of its already authorized water from anywhere on the perimeter of Lake Brazos. TCEQ says the city’s share of the certificate allows it to divert 2,153 acre-feet of water a year from the Brazos River, at up to 8.89 cubic feet per second (4,000 gallons a minute), for agricultural, municipal and mining use in Bosque, McLennan and Hill counties, and to keep an off-channel reservoir of up to 288 acre-feet in Bosque County. The commissioners will consider timely hearing requests, responses and replies (Docket No. 2026-1018-WR).

Proposed enforcement order. The agenda also lists an agreed order involving the City of Moody over municipal wastewater (Docket No. 2022-1111-MWD-E). The agenda does not list a penalty amount.

When and how to take part. The commissioners meet Wednesday, Oct. 21, 2026, at 9:30 a.m. at TCEQ headquarters in Austin (Building E, Room 201S), with the meeting also streamed on the TCEQ YouTube channel and open by Zoom and phone; connection details are in the agenda. People who want to speak on an item that is open for comment must register through TCEQ's Public Participation Form, by calling 512-239-3300 or by emailing agenda@tceq.texas.gov, and registration closes at 9:30 a.m. that day. The commissioners may take items out of order.
