Measures To Restrict Stockpiling of Polysilicon and Polysilicon Derivatives Under Proclamation 11052

Commerce’s Bureau of Industry and Security sets anti-stockpiling limits on polysilicon imports ahead of tariffs and minimum import prices that start December 4, 2026. Rule runs September 22–December 3. FR 2026-19537.

Companies bringing polysilicon into the country before new tariffs arrive are now being checked for stockpiling. A temporary rule from the Bureau of Industry and Security (BIS) took effect September 22, 2026, and lasts through December 3.

The backdrop: Proclamation 11052, issued August 6, 2026, found that imports of polysilicon and its derivatives threaten to impair national security and set minimum import prices and tariffs under Section 232, starting December 4, 2026. The rule says polysilicon is the base material for semiconductors and is essential to solar products.

Existing importers: Commerce is tracking who brings in volumes “substantially greater” than their history, comparing imports since August 6 with weekly averages for early 2026 and for 2025, and watching for affiliates or new importer accounts used to bring goods in. Importers flagged to Customs and Border Protection (CBP) are barred from further entries before December 4.

New importers (registered with CBP on or after August 6, 2026) face weekly caps unless Commerce approves more — HTSUS 2804.61.00: 12 kg. HTSUS 3818.00 (five listed subheadings): 7 kg. HTSUS 8541.42.00: 2,000 units. HTSUS 8541.43.00: 55 units. Go over, and further entries are blocked.

Customs brokers are reminded they must not help evade the limits; CBP enforcement could include license suspension or revocation and penalties. Restricted companies can apply for a waiver using the forms at www.bis.gov/232. Contact: Stephen Astle, Director, Defense Industrial Base Division, (202) 482-4506.
