Notice of Comment Period Extension on Proposed Consent Decree Under the Comprehensive Environmental Response, Cleanup, and Liability Act

People in North Jersey now have until November 14, 2026, to weigh in on a cleanup deal for the Lower Passaic River. The Justice Department pushed the comment deadline back 30 days in a Federal Register notice published October 5.
The deal is a proposed consent decree in United States v. Environmental Resource Holdings, LLC (Civil Action No. 2:26-cv-11675). DOJ lodged it on September 10, 2026, in federal court for the District of New Jersey. The case was filed for the EPA under the Superfund law, known as CERCLA.
What the defendant would have to do: start remedial work for Operable Units 2 and 4 of the Diamond Alkali Superfund Site. That includes building an upland processing facility to handle sediment dredged from the river before it is shipped off-site, plus support facilities for later dredging and capping. The defendant would also sample the lower 8.3 miles of the river to set a baseline and repay EPA for future oversight costs.
