Federal brief

Rescission of Executive Order 11246 Implementing Regulations

Labor’s OFCCP removes the regulations that carried out Executive Order 11246, including written affirmative action program rules for federal contractors. Effective October 26, 2026. FR 2026-17114.

Since 1965, Executive Order 11246 set equal-employment and affirmative-action rules for companies holding federal contracts. Its rulebook comes off the books October 26, 2026.

What happened: Executive Order 14173, signed January 21, 2025, revoked E.O. 11246. In a final rule published August 21, 2026, the Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) rescinds the implementing regulations and removes the E.O. 11246 parts of its enforcement-hearing procedures at 41 CFR part 60-30. The rule touches 41 CFR parts 60-1, 60-2, 60-3, 60-4, 60-20, 60-30, 60-40, 60-50 and 60-999.

What those rules required: covered contractors could not discriminate based on race, color, religion, sex, sexual orientation, gender identity or national origin, or punish workers for discussing pay. Nonconstruction contractors with 50 or more employees and a contract of at least $50,000 had to keep a written affirmative action program for each establishment, including workforce analyses and placement goals.

The Uniform Guidelines on Employee Selection Procedures in 41 CFR part 60-3 are rescinded in full. The Department says that does not affect how other agencies apply those guidelines. The Department also says significant parts of the old framework were legally vulnerable. Procedures for disability (Section 503) and veterans (VEVRAA) cases were handled in separate rulemakings.

The 2025 proposal drew 917 public comments. Contact: Kenneth Wolfe, OFCCP Director, 200 Constitution Avenue NW, Washington, DC 20210, 202-693-0101.
