Improvements to Rules on Recoupment of Benefit Overpayments
PBGC proposes simpler repayment rules for pension overpayments: a flat 5% of the monthly check, waivers for $250 or less, and no collection from surviving spouses. FR 2026-13639.
Sometimes a pension check is too big, and the government later asks for the extra back. The Pension Benefit Guaranty Corporation (PBGC) wants to make paying it back simpler and gentler.
PBGC insures private-sector pensions. When an underfunded single-employer plan ends, PBGC usually steps in as trustee and pays benefits, up to legal limits. Overpayments can happen during that handoff. This proposed rule covers how PBGC “recoups” those overpayments from people in single-employer plans it has taken over.
The main proposals: recoup at a flat 5 percent of a person’s monthly benefit, instead of today’s actuarial reduction that is generally capped at 10 percent; waive overpayments of $250 or less; stop collecting a retiree’s overpayment from a surviving spouse or other beneficiary; and generally stop recoupment after a revised benefit decision, with limited exceptions such as a later qualified domestic relations order (QDRO).
What stays the same: PBGC never charges interest on net overpayments, recoupment ends a month early if the last bit owed is smaller than the monthly reduction, and finishing recoupment counts as full repayment. The rule would also write PBGC’s practice for fixing payment errors into the regulations.
The comment period closed September 4, 2026. Nothing changes until PBGC issues a final rule. The rulemaking is RIN 1212-AB47; the contact is Joseph Krettek, Office of the General Counsel, 202-229-6772.
