Preproposal statement of inquiry was filed as WSR 24-07-041. Title of Rule and Other Identifying Information: The licensing division (LD) is amending WAC 110-16-0001 Purpose and authority (amended and renamed "Legal basis for the family, friends, and neighbors (FFN) child care subsidy program"), 110-16-0005 Definitions, 110-16-0010 Provider approval (amended and renamed "FFN provider application process"), 110-16-0015 Provider responsibilities, 110-16-0025 Health and safety training (amended and renamed "Training requirements"), 110-16-0030 Health and safety activities (amended and renamed "Annual health and safety visits"), 110-16-0035 Health and safety practices (This large WAC is being divided into multiple smaller WAC as outlined below. WAC 110-16-0035 is being renamed "Preventing and controlling infectious disease." The infectious disease content is original to WAC 110-16-0035.), 110-16-0040 Compliance (Compliance information is being relocated to a new WAC 110-16-0090. WAC 110-16-0040 is being renamed "Safe sleep environments for infants." Content was relocated from WAC 110-16-0035.), and 110-16-0045 Waiver from department rules (Waiver information is being relocated to new WAC 110-16-0100. WAC 110-16-0045 is being renamed "Preventing shaken baby syndrome, abusive head trauma, and child maltreatment." Content was relocated from WAC 110-16-0035.). LD is creating new WAC 110-16-0002 Purpose, 110-16-0007 FFN provider eligibility requirements, 110-16-0050 Food allergies and medication administration (content was relocated from WAC 110-16-0035), 110-16-0055 Illegal drugs, cannabis, smoking, vaping, and misuse of prescription drugs (content was relocated from WAC 110-16-0035), 110-16-0060 Keeping physical premises safe (content was relocated from WAC 110-16-0035), 110-16-0070 Emergency preparedness and response planning (content was relocated from WAC 110-16-0035), 110-16-0075 Transporting children (content was relocated from WAC 110-16-0035), 110-16-0080 Supervising children (content was relocated from WAC 110-16-0035), 110-16-0090 Compliance (content was relocated from WAC 110-16-0040), and 110-16-0100 Waivers from department rules (content was relocated from WAC 110-16-0045). Purpose of the Proposal and Its Anticipated Effects, Including Any Changes in Existing Rules: LD is creating and amending these rules to clarify requirements for FFN providers providing care for children getting services through the working connections child care subsidy program. These updates will also allow DCYF to better meet federal directives concerning the number of children in care under age two pursuant to recent audit findings. Reasons Supporting Proposal: See purpose. Statutory Authority for Adoption: RCW 43.216.055 , 43.216.065 , and chapter 43.216 RCW.
