Purpose of the Proposal and Its Anticipated Effects, Including Any Changes in Existing Rules: The purpose is to give the college discretion on designating an administrator to serve as the public records officer and updating the contact information for the public records officer. Reasons Supporting Proposal: The college has discretion on designating an administrator as the public records officer rather than identifying a specific administrator as the public records officer. Statutory Authority for Adoption: RCW 28B.50.140 , 42.56.040 , and 42.56.580 . Statute Being Implemented: RCW 28B.50.140 , 42.56.040 , and 42.56.580 . Rule is not necessitated by federal law, federal or state court decision. Name of Proponent: Lower Columbia College, public. Name of Agency Personnel Responsible for Drafting, Implementation, and Enforcement: Sam Orth, 1600 Maple Street, P.O. Box 3010, Longview, WA 98632, 360-442-2124. A school district fiscal impact statement is not required under RCW 28A.305.135 . A cost-benefit analysis is not required under RCW 34.05.328 . Pursuant to RCW 34.05.328 (5)(a)(i), the college is not mandated to comply with RCW 34.05.328 . Further, the college does not voluntarily make that section applicable to the adoption of this rule pursuant to subsection (5)(a)(ii), and to date the joint administrative rules committee has not made that section applicable to the adoption of this rule. This rule proposal, or portions of the proposal, is exempt from requirements of the Regulatory Fairness Act because the proposal: Is exempt under RCW 19.85.025 (3) as the rules relate only to internal governmental operations that are not subject to violation by a nongovernment party. Is exempt under RCW 19.85.025 (4). Explanation of exemptions: The proposed rule adopts revisions to designating the public records officer and updating the public records officer's contact information. It does not impact rights or responsibilities of small businesses. Scope of exemption for rule proposal: Is fully exempt.
