NRC Receives Blue Energy’s Part 1 LWA Filing for a BWRX-300 Electric Utility Plant at Port of Victoria, Texas

The U.S. Nuclear Regulatory Commission (NRC) published a notice of receipt in the October 8, 2026, Federal Register (91 FR 64409; FR Doc. 2026-20678) for the first part of a phased construction permit application, including a limited work authorization (LWA) request, from Blue Energy Global, Inc. / Blue Energy, Inc. for a single-unit BWRX-300 small modular reactor meant to supply the electric utility power grid at the Blue Energy Center in Victoria, Texas. The unit is named Blue Energy Center–Port of Victoria Nuclear Unit 1.
According to the notice, Blue Energy, Inc. filed Part 1 with the NRC on September 15, 2026, under Section 103 of the Atomic Energy Act and 10 CFR Part 50, using the phased-application path in 10 CFR 2.101(a)(9) and 2.600(d). The company says it intends to submit a full construction permit application no later than 18 months after the Part 1 submittal.
What Part 1 asks for
Part 1 includes an LWA request under 10 CFR 50.10(d) seeking NRC approval to conduct certain early construction activities for the BWRX-300 at the Port of Victoria site.
The submittal also includes two related exemption requests, an environmental report, applicable portions of the preliminary safety analysis report, administrative/financial qualifications information under 10 CFR 50.33, and technical information under 10 CFR 50.34.
What happens next
If NRC staff finds Part 1 acceptable for docketing, the staff will begin a detailed technical review. Later Federal Register notices will address docketing acceptability and opportunities for public participation.
NRC points the public to its advanced-reactor pre-application page for Blue Energy and to Docket ID NRC-2026-4654 on Regulations.gov. Docket No. 99902137. The notice is dated October 6, 2026, and signed by Jorge Hernandez Munoz, Acting Chief, Advanced Reactor Licensing Branch 4.
